These Terms and Conditions constitute a contract between the customer (you) and Genscience Sdn Bhd. These Terms and Conditions also apply on ordering, purchase, fulfilment and delivery of products from www.genscience.com.my. Please read the Terms and Conditions carefully before placing your Order. These Terms and Conditions contain important information about the ordering, processing, fulfilment and delivery of goods, including limitations of liability.

   • By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
   • You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
   • An immediate termination of your Services if there is a breach or violation of any of the Terms.

   • We reserve the right to refuse service to anyone for any reason at any time.

   • Prices displayed on our Website are subject to change without notice. Once an Order has been accepted by us and a Purchase Contract formed under clause 6, the price of the Product cannot be varied except:
   • by agreement between You and Us by email or any written format; or
   • in accordance with clause 7 (Payment).
   • All prices listed on our Website exclude Delivery Charges.
5. Product Specifications or Services
   • Products features and specifications described or showed in our Website are subject to change without notice. For the avoidance of doubt, we will not materially change the features and specifications of a Product once a Purchase Order has been accepted by Us and a Purchase Contract formed under clause 6.
   • We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
   • We may exercise this right on a case-by-case basis.
   • Products weights and dimensions that labelled in our Website are approximate.
   • We are unable to warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
   • Occasionally there may be information on our website that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
6. Purchase Orders
   • You may place an Order follow by the instructions on our Website. By placing an Order, you make an offer to enter into an agreement to purchase the Product(s) the subject of your Order (Purchase Contract).
   • Orders will be deemed to have been received by us at the time we send an Order confirmation to Your nominated e-mail address.
   • We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. In the event of a cancelled Order by us, funds paid in relation to that Order will be refunded in full. You will be provided with e-mail confirmation of the cancellation and refund.
   • We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
   • We do not accept any responsibility for Orders that are declined, delayed or not accepted due to disruptions with internet connections.
   • We shall not be liable for any delay in performing any of its obligations under this Agreement if such delay is caused by circumstances beyond the reasonable control and we shall be entitled to a reasonable extension of time for the performance of such obligations.
   • We may charge a redelivery fee if you have provided an incorrect or incomplete delivery address for Your Order.
7. Payment
   • Payment for Orders will be processed upon acknowledgement from us via email.
   • We requires upfront payment before placing orders upon our suppliers or dispatching goods. Items will not be ordered until receipt of payment has been received.
   • Unless otherwise stated, all payments are to be made to Genscience Sdn Bhd via cash, cheque or bank transfer into our bank account. Banking details will be provided upon confirmation of orders.
8. Installation and commissioning
   • Genscience Sdn Bhd will provide free installation and commissioning for products supplied by us within Klang Valley upon request.
   • We will contact you for installation arrangement. Kindly make sure the contact number is correct.
   • There will be charges for installation and commissioning for area outside of Klang Valley.
9. Refunds and Returns
   • Please note that we have a 'No Refund, No Exchange and No Return Policy' for all products sold and supply in good conditions. We ensure that all our products are in quality checked before we despatch to you.
   • We guarantee a replacement / exchange for all damaged, defective and incorrect items shipment. Buyer must notify us within 7 days upon received. We reserve the right not to entertain after above said period.
   • Returned Products, under the Returns Policy must be returned in their original packaging with all accessories, and must be in a re-saleable condition within FIVE (5) workings day.
   • It is the Customer's responsibility to ensure that returned items are returned safely and at your cost. We take no responsibility for Products lost in transit.
   • We will only refund in the form of credit note/voucher or exchange with other products. Only applicable to ex-stock items upon order.
   • We reserve the rights for final decision making.
   
   Dispute Resolution
   
   

   As an alternative to existing available dispute resolution methods, the Act provides if there is any dispute between one or more transaction, they may opt to refer the matter to KPDNKK for KPDNKK to adjudicate. The subject matter in dispute must be on any matter that is under the Act.

10. Warranties
    • Each Product sold on the Website is covered by a 12 months standard warranty from date of invoice from Genscience Sdn Bhd, Malaysia.
    • Warranty is only applicable for manufacturing defects and not for consumable items.
11. Intellectual Property
    • All Intellectual Property in any material on this website is the property of Genscience Sdn Bhd. Unless expressly authorised under these Terms and Conditions or otherwise, you may not reproduce, adapt, modify, display, perform or distribute any Material or any part of any Material.
12. Privacy
    • By placing your order or otherwise contacting us, you agree that we may store, process and use data collected from your order for the purposes of processing your Order. You also agree that we may use such data, other than financial details, in order to provide you with information from time to time on other Products or Products that may be of interest to you. You may obtain a copy of the data held by us concerning you on request in writing. We reserve the right to charge an administration fee for processing such request. If any data held by us concerning you is incorrect, we will correct it on your written request. Please refer to our Privacy Policy.
13. Discount vouchers and Promotion code
    • Discount vouchers and promotion code have a validity of specified at the time of issue in writing.
    • Discount vouchers and promotion code may be redeemed by entering the voucher code into the Discount Code field at checkout. Discount vouchers and promotion code will not be refunded.
    • Online promotions, discounts and gift items are not exchangeable and non-refundable. Promotions are subjected to stock availability.
14. Miscellaneous
    • Genscience Sdn Bhd reserves the right to make changes to our Website and these Terms and Conditions without notice. For the avoidance of doubt, any such changes will operate prospectively from the time that the revised Terms and Conditions are published on the website and will not impact any Purchase Contracts entered into prior to the date of the publication of the revised Terms and Conditions.
    • The information contained in this website is for general information purposes only. The information is provided by Genscience Sdn Bhd and while we endeavour to keep the information up to date and correct, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the website or the information, products, services, or related graphics contained on the website for any purpose. Any reliance you place on such information is therefore strictly at your own risk.
    • Through this website you are able to link to other websites which are not under the control of Genscience Sdn Bhd. We have no control over the nature, content and availability of those sites. The inclusion of any links does not necessarily imply a recommendation or endorse the views expressed within them.
    • If you do not agree to any of the terms, you agree that your sole and exclusive remedy is to discontinue using our Website.

    • A failure or delay by Genscience Sdn Bhd to exercise a power or right under these Terms and Conditions does not operate as a waiver of that power or right, and the exercise of a power or right by Genscience Sdn Bhd does not preclude its future ability to exercise that or any other power or right.
    • We also take all due care in ensuring that our website is free of any virus, worm, Trojan horse and/or malware, however we are not responsible for any damage to your computer system which arises in connection with your use of our website or any linked website.
    • We reserve the right to vary or cancel any promotion(s) and/or make changes and amendments to these Terms and Conditions on an ongoing, ad-hoc basis as needed and as legally/ethically required, and as at any other time it deems fit or necessary without prior notice. In the event of any dispute, the decision of Genscience Sdn Bhd shall be final and conclusive

• All delivery preparation or planning will be arranged after we had received full payment.
• Shipping charges may vary depending on products dimension/weight & order amount, plus the travel distance from your nearest capital city to your location.
• If you are engaging delivery service with us, please ensure the delivery address, receiver’s name and contact numbers are accurate and complete (including any business name if delivering to a work address) so that the delivery can be made on schedule.
• Ex-stock items will be processed within 5 -10 business days, if possible. Products are shipped within 10 business days (excluding weekends) from the date of receipt of your order with payment. If payment is paid by cheque, we will ship out once the cheque has cleared.
• Any item ordered which is out of stock or pre-order, please allow 8-12 weeks lead time to deliver. Your order will then be processed with high priority status.
• Genscience Sdn Bhd will not deliver Products to PO Box addresses.
• Genscience Sdn Bhd is not responsible for the delivery times of your order send by courier company. Once items have been dispatched, it is the customers responsibility to liaise with the courier nominated by Genscience Sdn Bhd (as notified to the Customer) in relation to date and time of delivery. Genscience Sdn Bhd shall not be liable for any inaccuracy of information provided to Customers relating to the date and time of delivery.
